By placing an order with SJR Growers Co, you agree to the following terms and conditions. Please read them carefully before purchasing.
1. Nature of Products
SJR Growers Co sells live plant starts, including vegetable, herb, and specialty varieties. Live plants are perishable by nature. While we take great care to grow, inspect, and deliver healthy plants, we cannot guarantee outcomes after delivery or pickup has been completed and accepted by the customer.
Product images are for illustrative purposes only and may not represent the exact plant you receive. You may receive a plant that is similar in size, but it will be healthy and true to variety.
2. All Sales Final — No Cancellations
All orders are final at the time of purchase. We do not accept cancellations, modifications, or returns. Once an order is placed, we begin preparing your plants specifically for your order. Please review your cart carefully before completing checkout.
3. Acceptance of Delivery
By accepting delivery or picking up your order, you acknowledge that the plants were received in satisfactory condition. SJR Growers Co is not responsible for plant health, loss, or decline after the point of acceptance.
4. Limitation of Liability
SJR Growers Co shall not be held liable for any damages, losses, or adverse outcomes arising from the purchase, delivery, handling, or use of our plants, including but not limited to:
- Plant loss or decline after delivery or pickup
- Transmission of plant viruses, pests, or disease to other plants or gardens
- Property damage of any kind
- Any indirect, incidental, or consequential damages
Our total liability to you for any claim arising from a purchase shall not exceed the amount paid for the order in question.
5. Plant Health Disclaimer
We do our best to ensure that all plants are healthy, vigorous, and free of visible disease or pest damage at the time of delivery. However, as with all living organisms, we cannot guarantee against naturally occurring conditions such as transplant shock, environmental stress, or latent disease. Proper care after receipt is the responsibility of the customer.
6. Delivery & Pickup Terms
Delivery and pickup are subject to the terms outlined in our Shipping & Delivery Policy, which is incorporated into these Terms of Service by reference.
7. Pickup Location — Private Residence Notice
Order pickup may be arranged at a pre-determined location in town or at our private residence, depending on availability and order details. All pickup arrangements require advance reservation, confirmed communication, and explicit agreement at the time of purchase. Pickup location and time will be provided in your order confirmation.
SJR Growers Co operates from a working private residence. We ask that all customers respect our neighborhood and our home. Under no circumstances should any individual be on our property or in our driveway unless a specific pickup time and location have been explicitly agreed upon at the time of purchase. Failure to comply with this policy may result in cancellation of future orders at our sole discretion. Thank you for your understanding and cooperation.
8. Pickup Reservation Fee
A non-refundable $5.00 reservation fee is required to secure all pickup orders. This fee is collected at checkout and confirms your pickup slot. It is not applied toward your order total. Pickup details and your confirmed time will be provided upon order confirmation.
9. No On-Site Shopping
SJR Growers Co does not offer on-site or walk-in shopping. All purchases must be made online in advance. During designated shop hours only, a curated selection of plants may be made available at the front of the property for viewing — a member of our team will be present during these hours. Outside of posted shop hours, no visitors are permitted on the property under any circumstances. Shop hours, when available, will be posted on our website and social media channels.
10. Delivery Area
Local delivery is available only within our designated delivery area (west of I-25 within a 5-mile radius from our Fairacres farm in Las Cruces, NM). Orders placed outside this area will not be fulfilled for delivery. It is the customer's responsibility to ensure their address falls within the delivery zone at the time of ordering.
11. Changes to Terms
SJR Growers Co reserves the right to update or modify these Terms of Service at any time without prior notice. Continued use of our website or placement of an order constitutes acceptance of the current terms.
